Terms of Service

The agreement#

This is an agreement between you — the person or company holding the account — and Metastable Lab, a company in Singapore. If you accept these terms on behalf of an organisation, you confirm you are allowed to bind it.

Your account#

You sign in with Google, with GitHub, or with a code sent to your email address. Your account carries one workspace, and the sessions and API keys under it are yours to manage: you can list and revoke both at any time.

An API key is a bearer credential. Anyone holding it can spend your credit, so treat it as a secret, keep it out of source control, and revoke it the moment you suspect it has leaked. Usage made with your keys is your usage, including usage you did not intend.

You must give an accurate email address and keep it current, because it is how we reach you about your account.

Credit, holds and charges#

Infimal is prepaid. You buy credit in US dollars, and requests spend it.

Each request places a hold against your credit before it is served, sized from the request itself and deliberately rounded up. When the request finishes, the hold settles to the actual charge at the published price for that model, and the unused remainder returns to your credit. If a request delivers nothing, the whole reservation is returned. If there is not enough credit to cover the hold, the request is refused before it is served, and nothing is charged.

Every balance, hold and charge you see in the console or through the API is read from the ledger, which is append-only. Those are the numbers we bill against; nothing is computed in your browser.

Credit is non-refundable, except where the law requires a refund. Payments, refunds and disputes are handled through Stripe; card details go to Stripe and never touch Infimal. If you dispute a charge, raise it with us at [email protected] first — we can usually resolve it faster than a chargeback can.

Prices are per model and are shown in the catalogue. We may change them; the catalogue is the current price, and a request is charged at the price in force when it is served.

Acceptable use#

You may not use Infimal:

• to produce, store or distribute content that is illegal, or to do anything illegal with it;
• to attempt to bypass a model’s safety behaviour, or to bypass metering, holds, billing or rate limits;
• to abuse an upstream provider that serves a model on our behalf, including breaking that provider’s own terms through us;
• to interfere with the service or with other tenants — probing, flooding, or trying to reach another tenant’s data, keys or requests.

Rate limits apply per account: a cap on requests per minute and a cap on concurrent streams. They exist so that one client cannot take the fleet down for everyone. Exceeding them means refused requests, not a larger bill.

Suspension and termination#

We may suspend or close an account that violates these terms, and we may do so immediately when the violation is doing harm — to us, to another tenant, or to an upstream provider. Where it is safe and practical to do so, we will tell you why and give you a chance to fix it.

You can stop using Infimal at any time, and you can ask us to delete your account by writing to [email protected]. Deletion removes your transcript archive; ledger entries are retained as the accounting record of money that moved.

Availability#

Availability is best effort. There is no service level agreement in the current release, and no uptime, latency or capacity guarantee. Models can be withdrawn, an upstream provider can fail, and capacity can run out; a request that cannot be served is refused with an error rather than silently charged.

We may change, add or remove models, features and routes. Where a change would break working integrations, we will give notice by email to account holders when we can.

Your content#

You keep whatever rights you have in what you submit and in what a model returns to you. We claim no ownership of it, and we do not use it to train models.

Chat, completion and transcription content is recorded to a private bucket as a transcript archive, kept for operating the service, investigating abuse and debugging, and deleted when the account is deleted. When a model is served externally, your request — including audio submitted for transcription — is forwarded to that provider, and that provider’s terms apply to what it does with it. The catalogue shows the source kinds for every model, so you can see which ones those are.

Model output is generated text or audio. It can be wrong. Check it before you rely on it for anything that matters, and do not present it as professional advice.

You are responsible for having the right to submit what you submit, including anyone else’s personal data or recordings in it.

Warranties#

Infimal is provided as it is. To the extent the law permits, we make no warranty that the service will be uninterrupted or error-free, or that model output will be accurate or fit for a particular purpose.

Liability#

To the extent permitted by law, Metastable Lab’s total liability arising out of or relating to these terms or your use of Infimal is capped at the fees you paid us in the three months before the event giving rise to the claim. Nothing in these terms limits a liability that cannot be limited by law.

Changes to these terms#

If these terms change, the effective date at the top changes with them. Continuing to use Infimal after a change means accepting the new version; if you do not accept it, stop using the service and write to us about the credit remaining on your account.

Governing law#

These terms are governed by the laws of Singapore, and the courts of Singapore have exclusive jurisdiction over any dispute arising from them. The company and all the infrastructure serving Infimal are in Singapore.
